THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.28554 of 2015 ORDER:

The petitioner is a fair price shop dealer of shop No.17 of Mallelaguda Village, Jawaharnagar, Shamirpet Mandal in Ranga Reddy District. The authorisation of the petitioner is valid up to 31.03.2017. While so, the shop was inspected on 28.08.2015 and some variation in the stock was noticed. Proceedings under Section 6A of the Essential Commodities Act were initiated against the petitioner. The present Writ Petition is filed when the stock was not supplied to the petitioner.

Learned Government, on the basis of written instructions, submits that no disciplinary proceedings are pending against the petitioner. It is clear from the above facts that the authorisation of the petitioner is valid and is in force till 31.03.2017. When the authorisation of the petitioner is in force, the petitioner is entitled for supply of stock for onward distribution to the cardholders.

In the circumstances, the Writ Petition is allowed directing respondent Nos.3 and 4 to supply the stock to the petitioner so long as his authorisation is valid and in force.
