This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused No.1 on bail in connection with Crime No.113 of 2022, on the file of Musheerabad Police Station, Hyderabad District, registered for the offence punishable under Section 8(c) read with 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "N.D.P.S.Act, 1985"). 2.

Heard learned counsel for the petitioner/Accused No.1 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of Musheerabad Police is that the petitioner/Accused No.1 was caught with 30 Kgs. of Ganja on 24.03.2022. He was remanded to judicial custody on the same day. 4.

Learned Assistant Public Prosecutor, on instructions, would submit that the sample of the contraband was seized and sent to Forensic Science Laboratory, which gave opinion that it was Ganja. Further, he also states that there are no other criminal cases pending against the petitioner.

In view of the detention of the petitioner since 24.03.2022, the petitioner can be granted regular bail on the following conditions: i) The petitioner/Accused No.1 is directed to be released on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each, upon which one shall be local and one shall be native, to the satisfaction of the learned XVII Additional Chief Metropolitan Magistrate, at Hyderabad.

ii) The petitioner/Accused No.1 shall appear before the concerned Police on every Monday between 10.00 A.M. and 05.00 P.M, for a period of twelve weeks or until filing of charge sheet, whichever is earlier. iii) The petitioner/Accused No.1 shall comply with the conditions as laid down under Section 437 (3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
