THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.38680 of 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the 3rd respondent in applying G.O.Ms.No.35 dated 30.01.2009 to the works executed by the petitioner as illegal and arbitrary. Heard the learned counsel for the petitioner and Sri M. Ravindranath Reddy, standing counsel for APSHC. It is the case of the petitioner that he successfully executed the works allotted to him by the third respondent in pursuance of the agreement No.DR/07/APSHCL/CE/2011-2012, Dated: 17.10.2011. It is the further case of the petitioner that the third respondent paid certain amounts to the petitioner as per the said agreement. The record reveals that the petitioner submitted a representation to the third respondent on 03.06.2015 with a request to pay the amounts as per the G.O.Ms.No.35 dated 30.01.2009. However, it is the grievance of the petitioner that the third respondent has not disposed of the said representation to so far.
The only relief sought by the learned counsel for the petitioner is to direct the third respondent to dispose of the representation submitted by the petitioner dated 03.06.2015 as expeditiously as possible.
In view of the submission made by the learned counsel for the petitioner, this Court is not expressing any opinion touching the merits of the main case.
Having regard to the submission made by the learned counsel for the petitioner, the third respondent is hereby directed to dispose of the representation dated 03.06.2015 submitted by the petitioner as expeditiously as possible, preferably, within a period of two months from the date of receipt of a copy of this order. Accordingly this Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
