In this writ petition, petitioners challenge the action of the State in not paying compensation to them for the lands acquired under the provisions of the Land Acquisition Act, 1894. The petitioners' grievance is that they claimed a sum of Rs.90,88,726/-, but they were paid a sum of Rs.72,05,082/-, leaving the balance sum of Rs.18,83,644/-. Considering the same, on 24.09.2018, this Court directed the learned District Judge, Kadapa to call for a report from the learned Senior Civil Judge, Rajampet, as to the status of E.P.No.4 of 1999 in O.S.No.1486 of 1988 and the amount, if any paid by the Government to the petitioners along with certified photocopies of the entire E.P. case record, including the proceeding sheet. In obedience to the same, the learned District Judged forwarded a report filed by the learned Senior Civil Judge, Rajampet.
In the said report, the learned Senior Civil Judge stated that after realisation of the decretal amount of Rs.30,54,922/-, the E.P. was dismissed on 01.02.2000 and as per the order, dated 06.06.2002, passed in C.R.P.No.238 of 2002, the said E.P. was restored to file and finally the same was closed on 20.01.2003 and that according to the Civil Court Deposits Register, the Land Acquisition Officer deposited a sum of Rs.40,12,438/- vide challan CCD No.942-A, dated 12.03.
be withdrawn leaving the balance sum of Rs.35,330/-. In other words, as on date, the amount stands released. Even assuming for argument sake, if any amount is left, the petitioners will have to work out their remedies as available under law. Therefore, granting liberty to the petitioners to work out their remedies, if any grievance subsists, the writ petition is closed.
