HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD Date:09.08.2018 Between:

P.Sunitha, W/o P.Srinivas .....Petitioner And:

The State Consumer Disputes Redressal Commission, Telangana and six others.

....Respondents Counsel for the petitioner: Mr. Ghanta Rama Krishna Counsel for respondent Nos.1, 2 & 7: AGP for Civil Supplies (TS) The Court made the following:

CVNR, J & GSP, J Dt:09.8.2018 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Petition is filed for the following substantive relief:

"... to issue a writ order or direction more in the nature of the writ of Mandamus declaring the inaction and inability on the part of respondent No.1 to hear the appeal in S.R. No.93 of 2015 along with its connected interlocutory application and pass appropriate order as illegal, untenable and without remedy to the petitioner and consequently, to pass such appropriate order to protect the interest of the petitioner pending hearing of the appeal by respondent No.1."

At the hearing, Mr. Ghanta Rama Krishna, learned counsel for the petitioner, submitted that though his client filed an Appeal before the State Consumer Disputes Redressal Commission, Telangana (for short 'the State Commission'), she was compelled to file the present Writ Petition as there was no quorum for the State Commission at that time and that, presently as the State Commission is functioning with due quorum, the Writ Petition may be closed to enable the petitioner to pursue the remedy already availed by her.

In the light of the above submission, the Writ Petition is closed, without adjudicating the same on merits, with liberty to the petitioner in terms of the prayer made.

CVNR, J & GSP, J Dt:09.8.2018 As a sequel to closure of the Writ Petition, interim order, dated 23.01.2015, as modified by order, dated 22.7.2015, is vacated and WPMP.No.893 of 2015 filed for interim relief shall stand disposed of as infructuous.
