THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5250 of 2019 ORDER:
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by petitioner/A1, seeking to grant anticipatory bail in Crime No.134 of 2019 on the file of Women Police Station, Begumpet, Hyderabad District, registered for the offences under Sections 498-A, 323, 506 IPC and under Sections 4 and 6 of Dowry Prohibition Act.

Heard learned counsel for the petitioner/A1, learned Additional Public Prosecutor representing the respondent-State and perused the record.

It is alleged in the complaint that A1 along with the other accused used to harass the de-facto complainant mentally and physically by demanding additional dowry. They also attacked her mercilessly while she was shouting, tied up her hands, legs and stamped her with their legs.

Learned counsel for the petitioner/A1 submits that the petitioner has not committed any offence and he was falsely implicated in the present case. He further submits that after marriage, the de-facto complainant started creating problems without any iota of reasons and she left the marital house without any reasons and living with her parents. He further submits that A2 to A5 were already granted anticipatory bail by this Court and that the petitioner is ready to furnish sufficient sureties to the satisfaction of the Court and he will abide by the conditions imposed by this Court while granting anticipatory bail.

As seen from the contents of the FIR, there are specific allegations against the present petitioner/A1 that he had illegal relationship with his brother's wife and he also blackmailed the defacto complainant that he would commit suicide if she conveys the same to her parents. In view of the serious allegations leveled against the petitioner, this Court is not inclined to grant anticipatory bail to him and his prayer for anticipatory bail is refused. However, if the petitoner/A1 surrenders before the trial Court within 15 days from today and moves an application for bail, the trial Court shall consider the same in accordance with law on the same day. 6.
With the above directions, the Criminal Petition is disposed of. 7.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
