Petitioner And State of Andhra Pradesh, Rep., by its Principal Secretary to Government, Panchayat Raj & Rural Department, 5th Block, Ground floor, Room No.104, Andhra Pradesh Secretariat, Amaravati, Guntur District & others.
.. Respondents This court made the following :
THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.6530 OF 2017 ORDER :
Heard. With the consent of both the counsel, the writ petition is disposed of at the admission stage. 2.
Petitioner claims that she was appointed as Field Assistant on 15.08.2007 in Bethapudi Village, Bapatla Mandal, Guntur District. According to the petitioner she worked up to 30.03.2016 and thereafter due to ill-health petitioner could not attend the duties. Petitioner now makes a representation that she should be taken back to duty and continue as Field Assistant. The appointment of petitioner as field Assistant was on contract basis for a fixed tenure. It is not in dispute that when the tenure period was over, the question of appointing/continuation of petitioner by re-inducting her as Field Assistant, after the tenure period is over does not arise. Therefore, the claim made by the petitioner that she should be reinstated as Field Assistant cannot be granted, as no lien exist to the petitioner to the post concerned, and on her own volition petitioner absented from duties. The writ petition is liable to be dismissed.
3.
Accordingly, the Writ Petition is dismissed. It is needless to observe that as and when the process of filling up of vacancies is taken up, it is open to the petitioner to participate in the selections. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
