THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NOS.31249, 31278, 31295, 31296, 31300, 31303, 31328, 31370 AND 31387 OF 2017 COMMON ORDER The petitioners in all these writ petitions, have been working as Secondary Grade Teachers, School Assistants and Language Pandit, respectively. They were suspended by the District Educational Officer during the years 2013/2014. Aggrieved by the action of the respondents in continuing the petitioners under suspension beyond two years, contrary to G.O.Ms.No.526, General Administration (Services - C) Department dated 19.08.2008, the present writ petitions have been filed.

The learned counsel for the petitioners submit that in similar facts and circumstances in a vacate petition filed by the respondent - Department in WVMP.No.210 of 2016 in W.P.M.P.No.27774 of 2015 in W.P.No.21546 of 2015 dated 14.02.2017, a Division Bench of this court passed the following order: "Given the fact that the first respondent has remained under suspension for over two years and as there is no possibility of the department proceedings concluding any time soon, the interim order dated 14.07.2015 is modified only to the extent of permitting the first respondent to apply to the competent authority seeking reinstatement in service in terms of G.O.Ms.No.526 dated 19.08.2008. In the event such a representation is made, the authorities shall consider the same in accordance with law and pass appropriate orders thereon. This exercise shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of the representation of the first respondent."

Heard the learned Assistant Government Pleader for Education. Having regard to the facts and circumstances of the cases' and the above order of the Division Bench of this court dated 14.02.2017, the writ petitions are disposed of permitting the writ petitioners to apply to the competent authority seeking reinstatement in service in terms of G.O.Ms.No.526 dated 19.08.2008. In the event such a representation is made, the authorities shall consider the same in accordance with law and pass appropriate orders thereon. This exercise

shall be completed expeditiously and in any event, not later than four weeks from the date of receipt of the representations of the petitioners'. No order as to costs.
