This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioners/Accused Nos.2 & 3 seeking to enlarge them on bail in connection with Crime No.66 of 2026, on the file of Vemsoor Police Station, Khammam District, registered for the offences punishable under Sections 111(2)(b) and 318(4) read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, (for short 'BNS'). 2.

Heard Sri Karthik Goud Burra, learned counsel for the petitioners as well as Sri Jithender Rao Veeramalla, learned

Additional Public Prosecutor appearing for the respondent-State. Perused the material available on record.

Learned counsel for the petitioners submits that the petitioners are innocent, the date in the complaint was wrongly mentioned as 10.11.2025 instead of 31.03.2026 and the alleged quantity of sand has been inflated and misrepresented and have been falsely implicated in the case. He further submitted that the petitioners have been in judicial custody from 04.05.2026 and that material part of investigation is completed. Therefore, learned counsel prays this Court to enlarge the petitioners/accused Nos.2 and 3 on bail.

On the other hand, learned Additional Public Prosecutor opposed for grant of bail to the petitioners as the offence alleged against the petitioners are serious in nature and hence prayed to dismiss the Criminal Petition.

Considering the submissions of both learned counsel and upon perusal of the material available on record, it is observed that there no specific overt-acts attributed against the petitioners herein. Further, the petitioners were taken into police custody on 04.05.2026 and since then, they are in judicial custody. Having regard to the nature of the allegations, period of incarnation and

the progress in the investigation, this Court is inclined to grant bail to the petitioners subject to the following conditions:- i) The petitioners/A2 & A3 shall be released on bail on their executing personal bonds for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each with two sureties for a like sum each to the satisfaction of the learned VI Additional Sessions Judge at Sathupally, Khammam, Telangana State.

ii) The petitioners/A2 & A3 shall appear before the concerned Investigating Officer on every Monday between 10:00 a.m. to 5:00 p.m. for a period of four (04) weeks or till filing of the charge sheet, whichever is earlier.

iii) The petitioners/A2 & A3 shall furnish their mobile number and surrender his passport, if any, before the trial Court and shall not leave the Country without prior permission from the trial Court.

iv) The petitioners shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses.

v) The petitioners/A2 & A3 shall not hamper the investigation or tamper with the prosecution evidence in any manner.

vi) The petitioners/A2 & A3 shall abide by the conditions stipulated under Section 480(3) of the BNSS.

vii) In the event of breach of any of the above conditions, the prosecution shall be at liberty to seek cancellation of bail.
