T.J.Jayakar v. B. Rama Raj
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.1896 of 2016
ORDER
This Contempt Case is filed alleging non-compliance of the order dated 22.03.2016 passed by this Court in W.P.No.9473 of 2016.
2.
On 22.08.2016, when the matter came up for admission, the petitioner was directed to place on record any authority empowering the Court to condone delay in initiating the proceedings under the Contempt of Courts Act, 1971, and thereafter, vide order dated 19.09.2016 in Contempt Application No.693 of 2016, this Court condoned the delay of 80 days in representing the contempt case and adjourned the matter to 08.11.2016, on which date, there was no representation for the petitioner and again on 30.12.2016 also, there was no representation for the petitioner and therefore, the matter was directed to be listed under the caption 'for dismissal'. Even today also, there is no representation for the petitioner. Since the writ petition is filed challenging the process of election conducted to the post of Director in Executive Category to the 5th respondentSociety, probably the petitioner is no more interested in prosecuting the contempt case.
3.
In view of the aforesaid circumstances, the Contempt Case is dismissed for non-prosecution. However, as can be seen from the interim order, the writ petition relates to the election to be conducted to the post of Director in Executive Category to the 5th respondent
Society, and by this time, such relief would become infructuous. Therefore, Office is directed to verify and post the writ petition for closing the same.
4.
Miscellaneous petitions, if any, pending in this contempt case, shall stand dismissed.
