THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.26829 of 2012 ORDER:
The grievance of the petitioner was that the Circle Inspector of Police, Kodangal Police Station, Mahabubnagar District, was calling him to the police station though there was no complaint or case against him and the same was being done under the guise of the rowdy sheet opened in his name without following the due process of law. He sought a consequential direction to set aside the said rowdy sheet if it was opened against him.
The Circle Inspector of Police, Kodangal Police Station, Mahabubnagar District, filed an additional counter-affidavit in July 2015 citing the involvement of the petitioner in three criminal cases, one of which he was acquitted in and the remaining two where he was bound over, and stated that a rowdy sheet had been opened in his name on the file of Kodangal Police Station pursuant to the proceedings dated 22.02.2008 of the Sub-Divisional Police Officer, Narayanpet, Mahabubnagar District. This rowdy sheet was stated to have been extended up to December 2015.
In the light of the afore-stated counter averments, Sri B. Shiva Kumar, learned counsel for the petitioner, stated that as the petitioner had already been acquitted in the first criminal case and was bound over for good behaviour in the other two cases, it would be necessary that the police authorities review the continuance and extension of the rowdy sheet opened in his name after December 2015. Learned counsel would submit that a direction in this regard would suffice to meet the interests of justice.
The writ petition is accordingly disposed of directing the police authorities to review the petitioner's case for extension of the rowdy sheet opened in his name beyond the year 2015. The police authorities would be bound to take into account the law laid down by this Court on this issue while examining the matter.
Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 31st August, 2015 IBL
