THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18271 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking issuance of Writ of Mandamus declaring the action of the third respondent in insisting the petitioners to settle the issue with 4th respondent by paying huge amount to her and further threatening the petitioners with dire consequences of implicating them in criminal cases if they fail to pay the amounts to 4th respondent, as illegal and arbitrary. Heard the learned counsel for the petitioners and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Though various grounds are raised in the writ petition, the learned counsel for petitioners restricts his prayer seeking a direction to the respondents-Police not to harass the petitioners by calling them to the Police Station, at the instance of 4th respondent, and threaten them to settle the dispute with the fourth respondent.

Though no counter is filed, the learned Assistant Government Pleader, on telephonic instructions, submits that the allegations made in the Writ Petition are false. Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondents-Police to follow due process of law and not to summon the petitioners to the Police Station, except in accordance with law.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
