This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to the petitioner/accused in Crime No. 206 of 2026 on the file of Falaknuma Police Station, Falaknuma Division, Hyderabad, registered for the offences punishable under Section 25(1)(A) of the Arms Act, 1959.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the respondent-State. 3.
The brief facts of the case are that the accused borrowed an amount of Rs.2,50,000/- from L.W.3 by promising to repay the same on 15.04.2026. However, as L.W.3 was troubling the accused to repay the amount, the accused was found roaming with knife having blade length of 9.5 inches, width of 1.5 inches, wooden grip length of 4.5 inches in order to eliminate L.W.3. Hence, the complaint.

Learned counsel for the petitioner submits that the petitioner is innocent and he was falsely implicated in the present case. He further submits that the petitioner is willing and ready to cooperate with the investigation and also ready to abide by the conditions as may be imposed by this Court. Hence, learned counsel prays this Court to allow the Criminal Petition by granting bail to the petitioner.

Per contra, learned Additional Public Prosecutor contended that since the allegations leveled against the
petitioner are serious in nature, he was arrested on 17.04.2026 and prays this Court to dismiss the Criminal Petition. However, he submits that the material part of the investigation is completed.

In the light of the submissions made by both the parties and upon perusal of the material available on record, it appears that the petitioner was in jail from 17.04.2026 and the remand report shows that all the witnesses have been examined and even according to the learned Additional Public Prosecutor, material part of the investigation is completed. 7.
Considering the facts and circumstances of the case and since the petitioner is languishing in jail from 17.04.2026, this Court deems it fit to grant bail to the petitioner/accused subject to the following conditions:
1) The petitioner/accused shall execute a personal bond for Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to the satisfaction of the learned XVI Additional Chief Judicial Magistrate at Hyderabad.
2) The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m., and 05:00 p.m., for a period of eight
(8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter as and when required
3) The petitioner shall abide by the other conditions stipulated in Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. 8.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
