HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No.14050 of 2017 Order:

Heard learned counsel for the petitioners and learned Government Pleader for the respondents 1 to 3. In view of the nature of disposal of the Writ Petition, the notice to the fourth respondent is dispensed with. This Writ Petition is filed by the President and office bearers of Town Level Federation challenging the registration of FIR No.45 of 2017 on 13.03.2017.

The fourth respondent lodged a complaint before the third respondent alleging that she is the leader of Slum Level Federation under the control of Town Level Federation and when the community organization tried to felicitate the petitioners on the Women's Day Celebrations, she objected on the ground that the persons who misused the funds should not be felicitated. She further alleged that in the course of said incident the petitioners abused her referring her caste name. The petitioners also lodged a complaint on 13.03.2017, which was registered as FIR No.46 of 2017. The petitioners state that the present complaint is a counter blast to the said complaint. A reading of the complaints shows that the present complaint is registered as FIR No.45 of 2017, whereas the complaint lodged by the petitioners is registered as FIR No.46 of 2017.

Learned counsel for the petitioners submits that if the third respondent verifies the video footage, it does not indicate the verbal abuses alleged to have been hurled by the petitioners.

shall not be arrested pursuant to registration of crime, but if there is a prima facie case the respondents 2 and 3 can take appropriate action. In any event, the third respondent shall continue the investigation in respect of the crimes registered against the petitioners and the fourth respondent. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
