Dasari Dalitha Labour Contract Co-Operative Society Ltd., v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.4550 OF 2017 COMMON ORDER:
Heard Mr.Syed Arif Basha, counsel for the petitioner and the learned Assistant Government Pleaders for for respondents.
2.
The petitioner, a society, complains against non-consideration of representation dated 02.07.2017 by 5th respondent as arbitrary and unconstitutional. Through the representation read above, the petitioner requested for consideration and allotment of house sites to eligible members in and around Ongole Town. The application is not considered and disposed of by 5th respondent. 3.
It is no doubt true that the representation was made on 02.01.2017 and without waiting for sufficient time, the petitioner is knocking the doors of this court. The counsel for petitioner submits that the respondents, while implementing several welfare programmes, are shortlisting the eligible candidates and if the claims of the members of petitioner society are not considered, they will suffer prejudice and injustice. Therefore, the instant writ petition has been filed. 4.
Be that as it may, prayer is against non-consideration or inaction in disposing of the
SVB,J W.P.No.4550 of 2017 representation dated 02.07.2017. Without expressing a view on merits on the membership, eligibility etc., and to meet the needs of justice, the Court is satisfied that the writ petition can be disposed of by this order:
a) Respondents 4 and 5 are directed to consider and dispose of the representation of petitioner, within three months from the date of receipt of this order; and b) Petitioner is given liberty to submit the list of registered members of petitioner society to respondents 4 and 5, by enclosing a copy of this order, within four weeks from today for timely action.
5.
Accordingly, this writ petition is disposed of as indicated above. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
