THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.4880 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A3 in Crime No.376 of 2022 on the file of Chandrayanagutta Police Station, Hyderabad, (S.C.No.112 of on the file of I Addl.Metropolitan Sessions Judge, Hyderabad), registered for the offences punishable under Section 20(B) (ii) (c) of NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

Learned Counsel for the petitioner/A3 submits that this Court vide order dt.12.11.2020 in Crl.P.No.5626 of 2020, granted bail to the petitioner by imposing condition that the petitioner shall appear before the concerned police till filing of charge sheet.

Learned Counsel for the petitioner submits that due to Covid infection, the petitioner could not attend the police station, for which reason the prosecution filed application before this Court seeking cancellation of bail and this Court vide order dt.23.09.2021 in Crl.P.No.4050 of 2021 cancelled the bail and this petitioner is in jail since then. 5.

Learned Assistant Public Prosecutor submits that there are no other cases pending against this petitioner. However, the trial has commenced and witnesses were already examined.

Keeping in view that there are no other criminal cases pending against this petitioner and that petitioner is in jail since 07.09.2021, the petitioner/A3 can be granted the relief of bail subject to the following conditions:

i) The petitioner/A3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of Chief Metropolitan Magistrate, Nampally, Hyderabad. ii) The petitioner/A3, after release shall appear before the concerned Court on every date of hearing, failing which the bail is liable to be cancelled.

iii) The petitioner/A3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed.
