- 2 - THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.16628 of 2018 ORDER :
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for respondents.
2.
According to petitioners, they are the owners of land to an extent Ac.13.05 guntas in Sy.No.476, Ac.7.08 guntas in Sy.No.484 and Ac.15.39 guntas in Sy.No.506 of Bollikunta Village, Fort Warangal Mandal, Warangal Urban District. In this writ petition, petitioners challenge the letter bearing Rc.No.B/222/2018 dated 02.04.2018, addressed by the Tahsildar, Khila Warangal Mandal, informing the District Collector that there is land available in Sy.Nos.506 and 484 of Bollikunta Village along with the sketch describing the location of land. It is an internal correspondence between the Tahsildar and District Collector. At this stage, it cannot be said that the Government is dispossessing the persons from the patta lands, when those persons are not in occupation of the Government lands.
Whether there is a Government land in the said survey numbers or wrong identification of the Government land is made is a question that can be gone into appropriate proceedings. It cannot be said that the persons who are in occupation of the lands in survey numbers of which are mentioned in Paragraph No.5 of the affidavit filed in support of the writ petition, would be dispossessed, without following the due process, more so, when it is the assertion of the petitioners that the lands are their private patta lands.
- 3 - inclined to entertain the writ petition on an internal correspondence and even before the notice is served or action is taken against the petitioners.
3.
Thus, the Writ Petition is dismissed leaving it open to the petitioners to work out their remedies as and when the petitioners are dispossessed from their private patta lands. There shall be no order as to costs.
Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
