THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 4399 OF 2008 O R D E R :

This Writ Petition is filed aggrieved by the inaction of the respondent in posting the petitioner as Assistant Lineman in the respondent Organisation.

Heard Sri R.M. Reddy, learned counsel for the petitioner and Sri R. Vinod Reddy, learned Standing Counsel for the respondents. A perusal of the record discloses that pending disposal of the Writ Petition, this Court passed an interim order dated 29.02.2008, directing to consider and dispose of the representations made by the petitioner on 15.11.2003 and 29.10.2004. As a matter of fact, the petitioner was terminated on 19.04.2004, invoking the Regulation No.28 (3) of APSEB Service Regulations, which was adopted by the 1st respondent. The factum of the petitioner having been terminated from service was not disclosed by the petitioner in the Writ Petition. Further, in the counter affidavit it has been categorically stated by the 3rd respondent that petitioner was continuously absent for five years between 01.06.1990 and 31.07.1994.

On earlier occasion also he absconded the office duties on so many times between 01.08.1983 and 12.10.1985. The averments in the counter affidavit have not been denied in the reply affidavit filed by the petitioner.

petitioner has not made out any case to allow the writ petition, this Writ Petition does not deserve any consideration. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, the miscellaneous petitions, if any pending, shall stand closed.
