This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioner who is arrayed as accused in Crime No.242 of 2026 before the Bhupalapally Police Station, Jayashankar Bhupalpally District.

Brief facts of the case are that on 19.05.2026 at 08:02 hours, the victim lodged a complaint stating that due to the death of her father, she joined as a Badli Worker at KTK in

2022. During her employment, she became acquainted with the accused, Kadarla Poornachander, Under Manager in SCCL. Their acquaintance allegedly developed into a relationship, and on several occasions the accused is said to have had physical relations with her at her residence by promising marriage. Believing his words, she continued the relationship. Later, when she insisted on marriage, she came to know that the accused was already married and had a son. Upon questioning him, he allegedly quarreled with her. Hence, she lodged the present complaint alleging cheating and sexual exploitation on the false promise of marriage, leading to registration of Crime No.242/2026 for the offence under Section 69 of BNS, 2023.

Heard Sri Sunkara Kalyan Dileep, learned counsel for petitioner, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the complaint is a clear counterblast to lawful steps initiated by the petitioner prior to the FIR. The petitioner had already

lodged a complaint with the SHO, Bhupalpally Police Station on 08.04.2026, dispatched on 09.04.2026 and delivered on 15.04.2026, narrating harassment and threats by the complainant. He also issued a legal notice dated 09.04.2026 and filed a private complaint before the competent Court bearing S.R. No.553/2026 against the complainant for offences under BNSS, 2023. It is contended that the complainant, with vindictive intention, filed the present case only after the petitioner refused her unlawful demands to leave his wife and marry her. The allegations are vague and omnibus, without specific dates or particulars. The relationship, if any, was consensual between two adults, and breach of promise to marry cannot ipso facto attract criminal liability unless it is shown that the promise was false from inception, which is not borne out.

While averring that the petitioner has no dishonest intention, is a permanent resident holding a respectable position in SCCL, and custodial interrogation is unnecessary, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition.

Learned Additional Public Prosecutor opposed the submissions stating that serious allegations of cheating and sexual exploitation on the false promise of marriage have been levelled against the petitioner. The victim has specifically narrated that physical relations were induced by promise of marriage, which later turned out to be false. The gravity of the offence and the impact on the victim cannot be ignored, and custodial interrogation is necessary to ascertain the truth and collect evidence. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to the rival submissions and material on record, it is noted that the complaint does not disclose specific dates or particulars of the alleged incidents, and the relationship appears to have been consensual between two adults. Therefore, this Court deems it fit to grant pre-arrest bail to the petitioner subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Bhupalapally Police Station, Jayashankar Bhupalpally District, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for

Rs.25,000/-, with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
