HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19004 of 2016 ORDER:
Heard learned counsel for the petitioner as well as the learned Government Pleader for Home and with the consent of both the parties, this writ petition is disposed of, at the admission stage.
This writ petition is filed seeking issuance of Mandamus declaring the action of the respondents in frequently visiting the petitioner's house without there being any complaint against him and harassing him by taking the photographs of his family members, as illegal and arbitrary and consequently sought a direction to the respondents not to harass the petitioner and his family members by visiting the petitioner's house.
The case of the petitioner is that his son was falsely implicated in a criminal case vide FIR.No.44 of 2013 of Karkhana Police Station, Karkhana, Secunderabad. He was arrested on 20.02.2013 and subsequently released on bail. It is the case of the petitioner that though the petitioner is not involved in any offence and no crime is registered against him, the respondents are visiting the house of the petitioner in odd hours and harassing him by taking the photographs of his family members and calling him to the police station.
The learned Government Pleader for Home
opposed the same stating that the allegations made by the petitioner are all false.
In view of the above facts and circumstances and without going into the merits of the case, this writ petition is disposed of directing the 4th respondent not to harass the petitioner by summoning him or his family members to the Police Station, except in accordance with law. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
