HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY Date:28.7.2017 Between:

Saripalli LInga Nookaraju, S/o Sanyasi ..... Petitioner And:

Pasumkarthy Suneetha, W/o Jagadeesh .....Respondent Counsel for the petitioner: Ms. A.Vara Lakshmi The Court made the following:

CVNR, J Dated:28.7.2017 ORDER:

This Civil Revision Petition is filed against order, dated 14.6.2017, in I.A.No.121 of 2015 in O.S.No.146 of 2012 on the file of the Senior Civil Judge at Chodavaram. I have heard Ms. A.Vara Lakshmi, learned counsel for the petitioner and perused the record.

The respondent filed the afore-mentioned suit for recovery of money. The petitioner has filed I.A.No.121 of 2015 seeking summoning of the plaint in O.S.No.105 of 2010 on the file of the same Court. The Court below has dismissed the said application on three grounds, viz., (1) that O.S.No.105 of 2010 was filed by the respondent against a third party; (2) that the petitioner has not specified in the affidavit as to whether O.S.No.105 of 2010 is pending or not; and (3) that if the petitioner is interested in getting the plaint copy in O.S.No.105 of 2010 marked in the suit, nothing prevented him from obtaining a certified copy thereof.

In my opinion, the third mentioned ground assigned by the Court below is sufficient for dismissing the petitioner's application for, the plaint in O.S.No.105 of 2010 being a public document, there is no reason for the petitioner not to obtain a certified copy thereof and get the same marked in the present

CVNR, J Dated:28.7.2017 suit. On this ground alone, the order of the Court below is confirmed.

The Civil Revision Petition is, accordingly, dismissed. As a sequel to dismissal of the Revision Petition, CRPMP.No.4630 of 2017 filed by the petitioner for interim relief is dismissed as infructuous.
