THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.30512 of 2012 ORDER:

This Writ Petition is filed seeking the following relief/s:- "It is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the impugned Tender Notification issued by the respondent vide No.E1/489/Sanitation/2012-13 dt. 23.09.2012 inviting tenders with regard to various works including the Supply of Sanitation workers for maintenance of sanitation work in Mandamarri Town, without paying 5 months salaries to the workers of the petitioner society and considering for extension pursuant to the representation dt.24.09.2012, as being illegal and arbitrary and consequently direct the respondent to forthwith pay the 5 month salaries to the workers of the petitioner society and to consider for extension of contract period, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."

[Reproduced verbatim] I have heard the submissions of the learned counsel for the writ petitioner. This Court on 28.09.2012 had passed the following interim order: 'Insofar as the impugned tender notice is concerned, there appears no ground legal or factual to stall further action on the same, while the petitioner is also at liberty to participate in the said tender process, if it so desires and if so advised. However, that does not give any justification for the respondent not to pay salaries to 53 sanitation workers for five (5) months inspite of performing their duties and therefore, the respondent shall either ensure payment of the salaries due to the said workers or place before the Court any reasons for non-payment of such salaries by the next date of hearing.' Subsequent thereto, the writ petition was being adjourned from time to time. Today, the learned Standing Counsel appearing for the respondent Corporation would submit that as per the instructions received by him, the salaries due to the workers have been paid.

Recording the said submission of the learned Standing Counsel for the respondent, the Writ Petition is dismissed as infructuous as no cause survives for adjudication. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
