HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39824 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the 2nd respondent to register a crime on the complaints of the petitioner dated 11.4.2016 and 4.11.2016. 2.

Heard and perused the material available on record. 3.

It is stated in the affidavit that as the surrounding plot owners of the petitioner started harassing him and preventing him from proceeding with the construction work in his plot, the petitioner lodged complaints before the 2nd respondent on 11.4.2016 and 4.11.2016. But the 2nd respondent refused to receive the complaints. Hence, the petitioner sent a copy of the complaint dated 4.11.2016 to the 2nd respondent by post. But no action has been taken so far.

Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion, the Writ Petition is disposed of with the following direction:

"The 2nd respondent is directed to register the complaints of the petitioner, if they disclose any cognizable offence, and proceed in accordance with law. If the 2nd respondent fails to register the complaints of the petitioner, he is at liberty to approach the superior officers or to avail the remedies that are available under the Code of Criminal Procedure."

No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
