Heard Sri S.M. Subhan, learned counsel appearing for the petitioner and Sri S.V. Ramana, learned Standing Counsel for the respondents-APSRTC.
2. The petitioner is a conductor in the respondentsCorporation. On 03-8-2015 while he was on duty at 02.00 p.m., a check was exercised and the petitioner was subjected to the test of Breath Analyser by the checking officials which was found to be positive. Thereafter, he was suspended pending disciplinary enquiry.
3. The learned counsel appearing for the petitioner submits that except the report of the Breath Analyser, there is no material on record showing that the petitioner consumed alcohol while he was on duty.
4. On the other hand, the learned Standing Counsel for the respondents-Corporation submits that since the impugned order is passed pending enquiry, it would not be appropriate to interfere with the order of suspension.
5. Considering the submissions on either side, the writ petition is disposed of directing the respondents-Corporation to complete the enquiry into the allegations levelled against the petitioner within a period of 4 (four) weeks and pass final
orders, failing which the order of suspension dated 10-82015 passed by the 3rd respondent shall stand revoked. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
