THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU ASMP No.2397 of 2017 And/in APPEAL SUIT No.307 OF 2011 ORDER: (Oral ) (Per Hon'ble Sri Justice SURESH KUMAR KAIT) ASMP No.2397 of 2017 has been filed by the petitioners/appellants to dispose of the A.S No.307 of 2011 by recording the terms of compromise as agreed among the parties herein in terms thereof.
2. Learned counsel appearing on behalf of the petitioners/appellants, on instructions from the appellants, who are present in Court, seeks permission to withdraw the instant petition, as the matter has been compromised out of the Court between the appellant and the respondent.
3. On identification of appellant No.1-D.Narasimha Chary @ T.Narasimha Chary, has produced original Aadhar Card vide No.7687 5521 6753. Photocopy of the same is taken on record. Original seen and returned to the appellant No.1. The appellant No.2-D.Laxmana Chary @ T. Laxman is concerned, he has produced original Aadhar Card vide No.4622 0537 2525. Photocopy of the same is taken on record. Original seen and returned to the appellant No.2.

The matter has been compromised vide Memorandum of Compromise filed under Order XXIII Rule 3 of CPC, which is at page No.3 of instant petition.
5. In view of compromise, ASMP No.2397 of 2017 is allowed. Consequently, A.S.No.307 of 2011 is disposed of in terms of compromise mentioned above.
Miscellaneous petitions, if any, pending shall stand closed.
