HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 12270 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in issuing proceedings dated 05.06.2002, whereby an amount of Rs.20,517-54 ps was ordered to be recovered from the salary of the petitioner, as illegal and arbitrary. When the matter is taken up for hearing, it is brought to the notice of the Court that at the time of retirement of the petitioner, the said amount was deducted from the terminal benefits of the petitioner. In view of the same, the cause in the writ petition does not survive. Accordingly, the writ petition is dismissed as infructuous. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
