HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.20082 of 2017 ORDER :

Heard learned counsel for the petitioner and also the learned Government Pleader for Civil Supplies appearing for the respondents. Perused the affidavit filed in support of the writ petition and other material available on record. 2.

This writ petition is filed by the petitioner seeking the following relief:

"...... Writ of Mandamus declaring the Proceedings of the 4th respondent in No.C/932/17, dated 25.05.2017, are illegal, arbitrary, contrary to the Control Order, beyond the powers of the 4th respondent, without jurisdiction and also contrary to the settled principles of law and set aside the same and direct the respondents to supply K.Oil stocks to me as usual as long as my license is in force and pass such other or further orders ......"

As per the learned counsel for petitioner, there is neither suspension order, pending enquiry passed against the petitioner nor any notice of enquiry issued, much less any final order passed by the authorities concerned as contemplated under law, nor any proceedings issued under Section 6-A of the Essential Commodities Act, 1955.

Having regard to the above, the impugned proceedings dated 25.05.2017 issued by the 4th respondent making alternative arrangements for distribution of Kerosene Oil is hereby cancelled, forthwith. However, this order will not preclude the authorities to proceed in accordance with law, if there is any requirement.

Accordingly, this writ petition is disposed of. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
