RespondenUCom pla ina nt Petition under Section 437 & 439 of Cr P.C, praying that in the circumstances stated in the grounds filed in the Criminal Petition, the High Court may be pleased to enlarge the petitioner on regular bail in FlR.NO.136 of 2021 on the file of the Asifnagar Police Station, Asrmagar, Hyderabad District in the interest of justice; The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of SRI SANJEEV GILLELLA Advocate for the Petitioner and the Assistant Public Prosecutor for the Sole Respondent, the Court made the following.
ORDER:
This Criminal Petition, under Section 439 of the Code of Criminal Procedure, 1973, is filed by the petitioner/Al for grant of bail in Crime No.136 of 2021 of Asifnagar Police Station, Hyderabad, registered for the offence punishable under Section 20 (b) (ii) (A) of Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard both sides. Perused the record.

As seen from the material placed on record, the Hash Oil (liquid ganja), which is in 20 small boxes (each box containing 5 ML), alleged to have been seized in the subject crime, is measuring about 100 ML. lt is conceded by the learned Assistant Public prosecutor that the quantity of Hash Oil seized is not a commercial quantity. This is a regular bail application of the petitioner/Al, who was remanded to judicial custody on Sl.Ol .ZOZI. lt appears from the record that material witnesses in this case were examined and most part of the investigation is completed. ln view of the nature of allegations and the material on record, the petitioner/Al can be enlarged on bail on certain conditions.

Accordingly, the petitioner/Al is ordered to be released on bail, subject to the following conditions:
(i) The petitioner/A1 shall execute a personal bond for a sum of Rs.25,0001 (Rupees twenty five thousand only) with two sureties in a like sum each to the satisfaction of the learned I Additional Chief Metropolitan Magistrate, Hyderabad.
(ii) After release on bail, the petitioner/Al shall appear before the Station House Officer, Asifnagar Police Station, Hyderabad, on every Sunday between 10:00 AM and 11:00 AM till filing of charge sheet.
(iii) During the bail period, the petitioner/Al shall not indulge in any crime.
(iv) The petitioner/Al shall not, directly or indirectly, meddle with the investigation, intimidate or induce the witnesses, tamper the evidence and he shall co-operate with the lnvestigating Officer for smooth completion of the investigation.

The Criminal Petition is, accordingly, allowed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
