ORDER
Heard learned counsel on either side.
This writ petition is filed seeking to declare the action of the 3rd respondent in terminating the petitioner from the duties of Field Assistant without issuing any prior notice, as arbitrary and illegal.
Vide order passed in April, 2015, by the 3rd respondent, the petitioner, who is a Field Assistant, was kept under suspension. Feeling aggrieved, the present writ petition has been preferred.
The impugned order does not indicate any specific charge against the petitioner. Hence, this Court is of the view that based on some vague and uncertain allegations, the petitioner cannot be placed under suspension. Further, the experience certificate dated 20.04.2015 issued by the 4th respondent filed along with the writ petition shows that the services of the petitioner from 28.03.2006 to 15.04.2015 for a period of nine years are found to be satisfactory. Having regard to the aforesaid circumstances of the case, the impugned termination order is hereby set aside. However, this order does not preclude the respondentauthorities to conduct enquiry against the petitioner based on any specific charges.
Writ Petition is, accordingly, allowed at the stage of admission. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ
petition shall stand closed.
