THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.8590 of 2012 ORDER:
The relief sought for in this writ petition is for a mandamus to declare the action of respondents 3 to 5, in calling the petitioner to police station without reason, as illegal and arbitrary. In the counter-affidavit filed by the Sub-Inspector of Police, II Town Police Station, Srikalahasti, Chittoor District, the allegation, that they had visited the house of the petitioner and had directed him to appear before them, is denied. It is further stated that the respondents never summoned the petitioner, and did not send any constables to his house for enquiry; and the allegation that he and his parents were called to the police station was false.
It is also stated that the petitioner or his parents are not required in any of the cases registered on the file of the II Town Police Station, Srikalahasthi; and the petitioner was never summoned by the police. In the light of the counter-affidavit, filed on behalf of the respondents, we see no reason to entertain this writ petition. Suffice it to make it clear that the respondents shall not call the petitioner to the police station, except on a Crime being registered against him, and in accordance with Section 41-A of Cr.P.C. The Writ Petition is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
