HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.20493 OF 2016 ORDER:
The case of the petitioners is that they were assigned lands to an extent of Ac.1.00 each in Survey No.761/176 of Bejjur Village and Mandal of Adilabad District and since then they were continuously enjoying the land and the revenue authorities have issued Pattadar Pass Books and Title deeds in their favour in respect of the aforesaid land. While so, the 4th respondent issued a notice dated 12.05.2015 to the petitioners under Section 3 of the A.P.Assigned Lands (Prohibition of Transfer) Rules, 2007 for which the petitioners submitted explanation on 27.05.2016 and 11.06.2016. But, without passing any orders on the same, the respondents are trying to resist the petitioners from cultivating the subject lands. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.
In view of the aforesaid facts and circumstances, since it is stated that the petitioners have filed explanation in pursuance to the notice dated 12.05.2015 issued by the 4th respondent, the 4th respondent is directed to pass final orders after affording opportunity to the petitioners within a period of six (6) weeks from the date of receipt of copy of this order. Till such time, the respondents shall not interfere with the possession of the petitioners over the subject land.
Accordingly, the writ petition is disposed of. No order as to
costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
