THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.9321 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) Learned counsel for the petitioner submits, in our view fairly, having regard to the

amount of property tax involved, that his client will make a representation to the Municipal Commissioner for grant of suitable instalments for payment of the tax, instead of pressing this matter before us.

In view of the aforesaid submission, we close this writ petition with liberty to the petitioner to make a representation to the Commissioner of the second respondent Municipal Corporation. The Commissioner will consider such representation sympathetically taking into consideration the financial position of the petitioner. To enable the petitioner to make such representation, we grant seven days time. In the event such representation is made within this time, the Commissioner will consider the same in terms of this order and pass a reasoned order within four weeks thereafter. The Commissioner will be free to take action in accordance with law. If no representation is made, then the issue will be a closed chapter. Till a decision is taken on the representation of the petitioner, we direct the Corporation not to take any coercive measures against the petitioner. If any payment is made by the petitioner by this time, then suitable adjustment shall be given to the same. Pending miscellaneous petitions, if any, shall also stand closed. There will be no order as to costs.
