HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.805 of 2014 ORDER:

This petition is filed to withdraw O.P.No.610 of 2014 from the file of Family Court, Vijayawada and transfer the same to Family Court, Visakhapatnam for disposal in accordance with law.

2. Petitioner herein is wife and she filed her affidavit in support of petition, according to which, her marriage with respondent was performed on 22.05.2006 at Vijayawada as per Christian Rites and customs, due to differences, she is living separately from October 2013 at her parents' house in Visakahapatnam. According to her affidavit, she lodged a complaint with police and thereafter respondent/husband filed O.P.No.610 of 2014 before Family Court, Vijayawada for dissolution of marriage.

According to her affidavit, O.P. was intentionally filed at Vijayawada only to harass her. She stated that it is difficult for her to travel a distance of more than 400 KMs from Visakahaptam to Vijayawada and that she has no one to escort her. She further stated that she is not in a position to meet travel expenditure. She further stated that she apprehend life threat in the hands of respondent at Vijayawada, and for these reasons, she prayed for transfer of O.P No.610 of 2014 from Vijayawada to Visakhapatnam.

3. Respondent in spite of service of notice neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Advocate for petitioner/wife submitted that petitioner is house wife and she has no source of income and dependent on her parents and it is difficult for her to meet travel expenses and that she has no

male assistance to escort her.

6. I have perused the material papers including affidavit of petitioner filed along with transfer petition. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P No.610 of 2014 is withdrawn from the file of Family court, Vijayawada and transferred to Family Court, Visakhapatnam for disposal in accordance with law.

7. Accordingly, the Transfer Miscellaneous Petition is allowed. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
