HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2502 OF 2017 ORDER:
The case of the petitioners is that they are the owners of various extents of land in Survey No.23/3 of Lankapalli Lanka Village, Pamidimukkala Mandal, Krishna District having purchased the same through registered documents. While so, they have submitted application to the 2nd respondent for decasting of sand from the aforesaid lands. As per the Memo issued by the Government vide No.3099/M-II (1)/2016/3, dated 22.03.2016, the de-casting of sand from the patta lands shall be permitted only after verification of ownership, fixation of boundaries and assessment of sand quantity to be removed. The Assistant Director of Mines and Geology addressed a letter dated 12.04.
2016 to the 4th respondent to inform about the classification and availability of the applied area duly obtaining the specific report from the Agricultural department whether the land is fit for cultivation or not after de-casting of sand from the area so as to process the application for grant of permission for de-casting of sand in patta lands in Krishna River basin in favour of petitioners. Subsequently, as no action is taken on the applications of the petitioner nor on the letter of the Assistant Director of Mines and Geology, petitioners submitted representation on 04.11.2016 to the Deputy Chief Ministercum-Revenue Minister and on such representation the Deputy Chief Minister made an endorsement dated 12.11.
directing the 3rd respondent to examine and do the needful. In pursuance to the said endorsement, the 3rd respondent addressed a letter dated 16.11.2016 to the 4th respondent by forwarding the applications of the petitioner and to enquire into the matter as per rules in force and inspect the proposed land in consultation with the Agriculture Officer, Pamidimukkala and send detailed report on the feasibility of the land. But, till today, the 4th respondent has not conducted any survey of the subject lands. Aggrieved by the same, present writ petition is filed. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue.
Since it is stated that basing on the applications of the petitioners, respondent authorities have also addressed letter directing the 4th respondent to submit report, it is for the 4th respondent to submit report to take further action. In view of the above, the writ petition is disposed of directing the 4th respondent to take action in terms of the letter addressed by the 3rd respondent dated 16.11.2016, within a period of two months from the date of receipt of a copy of this order. No order as to costs.
As a sequel thereto, miscellaneous applications, if any, pending, shall stand closed.
