O R D E R

This Criminal Petition is filed under Sections 480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking to enlarge him on bail in connection with Crime No.19 of 2026, on the file of the Excise Station, Ameerpet, Hyderabad, registered for the offences punishable under Sections 8 (c) r/w. 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

Brief facts of the case are that on 28.04.2026, the petitioner was apprehended by Prohibition & Excise officials near Vijetha

Theater, Hyderabad, while he was in possession of 2.068 kgs of ganja and three mobile phones and the same were recovered from his possession;

petitioner was allegedly transporting the contraband for sale; thus a case in Crime No.19 of 2026 of PS Excise, Ameerpet, was registered under Sections 8 (c) r/w. 20(b)(ii)(B) of the NDPS Act, 1985.

Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor appearing for the respondent-State and perused the material available on record. 4.

The allegations leveled against the petitioner are that the petitioner was transporting 2.068 kgs of dry ganja for the purpose of selling it to consumers in Hyderabad and thereby engaging in illicit trafficking of cannabis.

Learned counsel for the petitioner submits that the petitioner is innocent, and he has been falsely implicated in the present case. It is further submitted that as of now, the petitioner is not involved in the sale of ganja as alleged and he has been in judicial custody from 28.04.2026. Therefore, learned counsel prays this Court to enlarge the petitioner/accused on bail.

On the other hand, learned Additional Public Prosecutor opposed for grant of bail to the petitioner as the offences alleged

against the petitioner are serious in nature and hence, prayed to dismiss the Criminal Petition.

A perusal of the record reveals that there no specific overtacts attributed against the petitioner herein. Further, the petitioner was taken into police custody on 28.04.2026 and since then, he has been in judicial custody. Having regard to the nature of the allegations and as the material part of investigation was completed, this Court is inclined to grant bail to the petitioner subject to the following conditions:- i) The petitioner shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned III Additional Chief Judicial Magistrate, Hyderabad. ii) The petitioner shall appear before the Investigating Officer concerned on every Monday between 10:00 a.m. to 5:00 p.m. for a period of four (04) weeks or till filing of the charge sheet, whichever is earlier. iii) The petitioner shall furnish his mobile number and surrender his passport, if any, before the trial Court and shall not leave the Country without prior permission from the trial Court.

iv) The petitioner shall not directly or indirectly influence, threaten, or induce any of the prosecution witnesses. v) The petitioner shall not hamper the investigation or tamper with the prosecution evidence in any manner.

vi) The petitioner shall abide by the conditions stipulated under Section 480(3) of the BNSS.

vii) In the event of breach of any of the above conditions, the prosecution shall be at liberty to seek cancellation of bail.
