THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY AND THE HON'BLE SMT. K. VIJAYA LAKSHMI Writ Petition No.946 of 2004 DATED:21-09-2017 Between:
The Secretary A.P. Public Service Commission Nampally, Hyderabad ... Petitioner And State of A.P.
Represented by its Principal Secretary to Government, Home Department A.P. Secretariat and others ... Respondents COUNSEL FOR THE PETITIONER: Mrs. B. Kavitha, for Mr. C. Srinivasa Baba COUNSEL FOR RESPONDENT NOs.1 and 2 :
COUNSEL FOR RESPONDENT NO.3 to 5 : G.P. for Services (TS) THE COURT MADE THE FOLLOWING:
ORDER: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for the following substantive relief: "...to issue a writ, order or direction, especially one in the nature of writ of certiorari to quash orders dated 11-8-2003 in O.A. No.427 of 1998 as covered matter in O.As.6141/95 and 2470/2001 passed by the A.P. Administrative Tribunal."
A perusal of the record shows that on 19.04.2011 four weeks' time was granted for complying with the office objection by paying the batta due and furnishing the correct addresses of respondent Nos.1 and 2, with the condition that in default the writ petition stands dismissed against the said respondents without further reference to the Court. The Office report shows that the petitioner failed to comply with the office objections. Hence, by operation of the conditional order dt.19.04.2011, the writ petition stood dismissed for default against the said respondents. The said respondents being the applicants in O.A. No.427 of 1998, wherein the impugned order was passed in their favour, with the dismissal of the writ petition against them the cause therein does not survive for adjudication.
The writ petition is accordingly dismissed as infructuous. As a sequel to dismissal of the writ petition, interim order dt.21.01.2004 granted in W.P.M.P. No.1243 of 2004 shall stand vacated and the said application shall stand disposed of infructuous. __________________________ C.V. NAGARJUNA REDDY, J _________________________ K.
