Heard the Assistant Government Pleader for Revenue. The petitioner prays for mandamus declaring the action of 1st respondent, Cantonment Board in insisting upon the petitioner to get a 'No Objection Certificate' from the 2nd respondent-District Collector for granting permission to construct flats on an extent of 755.55 sq.yards equivalent to 631.64 Mtrs and situated in Plot No.12 of Sy.No.74/9 of East Marredipalli Secunderabad Mandal, as illegal and unconstitutional. Keeping in view the nature of prayer and also with the passage of time, this Court is of the view that the petitioner is not interested in working out the prayer.
Hence, the writ petition is dismissed for default. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
