THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38471 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 2nd respondent in registering the FIR No.331 of 2016, as illegal and arbitrary. Heard and perused the material available on record. The main grievance of the petitioner is that the 3rd respondent is the brother of the petitioner and there are some property disputes pending between them. The 3rd respondent has lodged the present complaint before the 2nd respondent, which was registered as FIR No.331 of 2016 for the offences punishable under Section 420, 468, 471 IPC against the petitioner alleging that the petitioner has forged the signature on the rental agreement, dated 16.04.2012.

Considering the facts and circumstances of the case, the petitioner is directed to surrender before the 2nd respondent on 25.11.2016 and on such surrender, the 2nd respondent is directed to take him into the custody and obtain his signatures for the purpose of investigation and release the petitioner on that day itself on execution of a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety to the satisfaction of the 2nd respondent and the 2nd respondent is directed to complete the investigation in FIR No.331 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
