Sanjay Kumar Agarwal v. The Union Of India
THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4791 of 2022 ORDER:
This Application has been filed seeking relaxation of the condition imposed by the Metropolitan Sessions Judge-cum-Special Judge for Trial of Prevention of Laundering Act, Hyderabad, in Crl.M.P.No.2352 of in ECIR/08/HYZO/2012, dated 02.06.2022, whereunder while granting bail to the petitioner/accused No.1, he was directed to execute personal bond for a sum of Rs.50,000/- with two sureties for a like sum each. 2.
Counter filed by the learned counsel for respondent opposing the application.
3.
Heard learned counsel for the petitioner/accused No.1, the learned counsel for respondent No.2 and perused the record. 4.
Learned counsel for the petitioner/accused No.1 submits that the petitioner was granted bail on 02.06.2022 by imposing a condition of furnishing personal bond for Rs.50,000/- with two sureties for a like sum each.
5.
The present petition is filed seeking relaxation of the condition on the ground that the petitioner is unable to secure the said amount. The petitioner was already granted bail on 02.06.2022.
However, due to his incapacity, the petitioner is unable to furnish surety.
6.
Learned counsel for Directorate of Enforcement having filed counter would submit that Rs.50,000/- surety has to be imposed in the facts and circumstances of the case. However, keeping in view incapacity of the petitioner, this Court is inclined to reduce the surety amount from Rs.50,000/- to Rs.25,000/- with two sureties for the like sum each.
With this modification, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
