THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.6694 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crime No.548 of 2023 on the file of Saroornagar Police Station, Rachakonda, registered for the offences punishable under Sections 376 (2) (n), 312 and 417 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of prosecution is that the victim girl and the petitioner were acquainted with eachother for 3 years prior to the complaint. The victim was taking coaching for the post of Sub-Inspector in Dilsukhnagar area and residing at Bhavaninagar. The petitioner proposed to her. They had sexual intercourse multiple times. She got pregnant and her two months pregnancy was later aborted. Since the petitioner did not marry her and promised to marry her once he settles in life and as he was not ready to marry, the complaint was filed.

Learned counsel for the petitioner would submit that even going through the complaint, the relationship between the petitioner and the victim was consensual in nature for a period of three years. The only reason for lodging a complaint is that the petitioner promised to marry her, but failed to do so. In fact, the petitioner was searching for a job and subsequently wanted to marry the victim. However, the present complaint was filed in the meanwhile.

Learned Public Prosecutor opposed the grant of bail on the ground that there is an allegation under Section 312 of IPC. He would further submit that the victim was already examined and statement was recorded.

As seen from the remand report, major part of the investigation appears to be complete.

Keeping in view that the petitioner and the victim were in relation over a period of three years, this Court deems it appropriate to grant bail subject to the following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of V Additional Junior Civil Judge-Cum-V Additional

Metropolitan Magistrate Court, Ranga Reddy District at L.B.Nagar.

ii) The petitioner/Accused, after release shall appear before the concerned Station House Officer every Monday between 10.30 AM and 01.00 PM for a period of eight weeks and thereafter as and when required, for the purpose of investigation.

(iii) The petitioner shall not in any manner go near the victim or try to contact her. In the event of the petitioner contacting the victim or in any manner or influence the witnesses, the Police are at liberty to take steps for cancellation of bail.

iv) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 8.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed. _________________ K.SURENDER, J Date: 28.07.2023 dv
