This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 by the petitioner praying this Court to enlarge him on bail who is arrayed as accused No.1 in Crime No.19 of 2026 of Dudyal Police Station, Vikarabad District. The offences alleged against the petitioner are under Sections 109, 118 (1), 352 r/w.3(5) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that on 28.02.2026, while the parents of the de facto complainant were collecting tamarind
- 2 - fruits, the accused persons, owing to previous land disputes between the families, allegedly assaulted the complainant and her family members with sticks, stones, and an axe, causing injuries to them. It is further alleged that the petitioner along with other accused abused the complainant and her family members in filthy language and attempted to attack them during the incident. Based on the complaint, the police registered the present crime for the above offences. 3.
Heard Sri R. Prasanth, learned counsel appearing for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that petitioner herein is arrayed as A.1 and the allegation against him is that he attacked the complainant. In fact petitioner was not present at the scene of offence and he is falsely implicated in this case. He further contended that petitioner is in jail from 23.04.2026 and that material part of investigation is already completed and all the other accused were granted bail. Hence, prayed this Court to grant regular bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed bail contending that petitioner herein is not only accused in this case, but he is also involved in many other cases and a rowdy sheet is also opened against him. Considering the severity of allegations against the petitioner and also the previous antecedents, petitioner is not entitled to bail and prayed to dismiss this petition.

Having regard to the submissions made by the learned counsel for the petitioner and the learned Additional Public Prosecutor, as well as the material placed on record, the petitioner is arrayed as A.1 and he is in jail from 23.04.2026 and the allegation against him is that he attacked on the victim with an axe due to which she sustained injury on the vital part, whereas the contention of learned counsel for the petitioner is that the victim was treated as outpatient and there is no such grievous injury sustained by her. Considering the period of incarceration of petitioner and the nature of injury inflicted on the victim, this Court deems it fit to grant bail to the petitioner subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like
- 4 - sum each to the satisfaction of the Judicial First Class Magistrate at Kodangal, Vikarabad District.
ii.
The petitioner shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
