HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No. 8741 of 2006 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard Mr.N.Vijay, learned counsel for the petitioner and Mr.A.Panduranga Rao, learned Standing Counsel for the respondent. This Court on 26.04.2006, while admitting the writ petition, granted interim stay as prayed on condition that the petitioner should deposit an amount of Rs.5,00,000/- within a period of four weeks from the date of the order. It is clear from the counter-affidavit filed by the respondent that till today, the petitioner has not deposited the amount as per the directions issued by this Court. Mr.N.Vijay states that he is not receiving any instructions.
In view thereof, we find no reason to keep this petition pending any further.
Hence, we dismiss the writ petition for non-prosecution. It is open to learned counsel for the petitioner to apply for restoration of the writ petition, if the statement made in counter-affidavit filed by the Corporation is incorrect or if he has any other instructions in the matter.
