CVNR, J CC 1865/2016 ORDER:

This contempt case is filed alleging wilful disobedience of interim order dt.24.11.2015 in W.P. No.38033 of 2015. The petitioner filed this contempt case with Application No.806 of 2016 for leave to permit him to implead respondent Nos.2 to 10 in the contempt case on the allegation that they have been raising construction unlawfully in spite of subsistence of the aforementioned status quo order passed by this Court. The said leave application was dismissed by this Court on 17.9.2016 by taking the view that the interim direction was issued only against the State of Andhra Pradesh and two others and that the proposed respondent Nos.2 to 10 were neither parties to the writ petition, nor any direction was issued against them.

As the entire basis for the contempt case is that the order of status quo is being violated by the proposed respondent Nos.2 to 10 and the leave application having been dismissed, the contempt case does not survive for adjudication qua the remaining respondent, i.e., the Chief Executive Officer, Andhra Pradesh State Wakf Board, who is not proceeding with the construction. For the aforementioned reasons, the contempt case is dismissed. _______________________ C.V.
