THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No.470 of 2017 ORDER:

This Contempt Case is filed alleging non-compliance of order, dated 20.02.2017 passed by this Court in WPMP.No.7112 of 2017 in Writ Petition No.5827 of 2017.

The operative portion of the aforesaid order reads as under: "Hence, it is for the department to verify the source and invoice and in case they are found to be fake, necessary action can always be taken against the petitioner. There shall therefore, be an interim direction to forthwith release the vehicle bearing No.MH 12 HC 5499 on the petitioner furnishing a personal bond before the 3rd respondent."

Though the learned counsel for the petitioner submits that the material has not been released, as there being no direction issued by this Court in the aforesaid order for release of the material, there cannot be any contempt on the part of the respondent for not releasing the material as the direction issued is only in relation to the release of the vehicle in question. It is also stated in the counter-affidavit filed by the respondent that accepting the personal bond given by the petitioner, the vehicle in question was released on 06.03.2017 i.e., within four days of furnishing personal bond.

Accordingly, the Contempt Case is closed.
