Heard Mrs. G.Jhansi, learned standing counsel for the appellants/D.1 & D.2 and Sri S.Subba Reddy, learned counsel for the 1st respondent/1st plaintiff.

2. Learned counsel appearing for the 1st respondent/1st plaintiff submits that the 1st plaintiff filed a memo before the trial court seeking withdrawal of the suit.

3. In view of the same, the appeal is allowed, but in the circumstances, without costs. Miscellaneous petitions, pending if any in this case, shall stand closed.
