THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40123 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 2nd respondent in not registering a case in pursuance to the petitioner's complaint, dated 03.10.2016, as illegal and arbitrary and consequently, direct the 2nd respondent to register case against on the basis of the complaint lodged by the petitioner on 03.10.2016. Heard and perused the material available on record. The main grievance of the petitioner is that the 2nd respondent is not registering a case basing on the complaint lodged by the petitioner, dated 03.10.2016.

Considering the grievance of the petitioner, without going into the merits of the case, the 2nd respondent is directed to register a case on the basis of the complaint lodged by the petitioner, dated 03.10.2016, if it discloses any cognizable offence and investigate into the same and file a final report if any. If the petitioner is aggrieved by the action of the 2nd respondent, he is liberty to approach the superior authority of the 2nd respondent and also the concerned Court, by invoking provision under Section 200 Cr.P.C. Accordingly, the writ petition is disposed of. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed. ______________ RAJA ELANGO, J November 21, 2016.
