HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5288 OF 2019 ORDER:

This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') is filed by the petitioners - accused Nos.1 to 5 viz., Aennampalli Haribabu, Aennampalli Manohar, Aennampalli Suguna, Kotagiri Laxmi and Kotagiri Thukkaiah, respectively, seeking to quash the proceedings against them in D.V.C. No.5 of 2019 on the file of the learned Judicial Magistrate of First class, Luxettipet.

2. Heard Sri K. Venumadhav, learned counsel for the petitioners, and learned Additional Public Prosecutor appearing for the State, and perused the material on record.

3. Though the present Criminal Petition is filed seeking to quash the aforesaid proceedings against the petitioners, learned counsel for the petitioners restricts the prayer seeking to dispense with the presence of the petitioners before the trial Court on every date of adjournment.

4. The learned Additional Public Prosecutor submits that since identity of the petitioners is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment.

5. Having regard to the facts and circumstances of the case, personal appearance of the petitioners herein (accused Nos.1 to 5) in

D.V.C. No.5 of 2019 on the file of the learned Judicial Magistrate of First class, Luxettipet, is hereby dispensed with while permitting them to mark their appearance through their counsel, except on the dates when their presence is specifically required by the said Court.

6. With the above directions, the Criminal Petition is disposed of.

As a sequel thereto, Miscellaneous Petitions, if any pending, in the criminal petition stand closed.
