THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.16424 of 2007 ORDER:

This writ petition is filed seeking to issue a Writ of Mandamus declaring the action of the 1st respondent in issuing proceedings in R.C.No.M2/25575/2006 dated 01.12.2006 to conduct a public auction in respect of the petitioners' shops without properly considering the recommendations made by the Fair Rent Committee vi de its report as arbitrary, illegal and consequently direct the 1st respondent to consider the Fair Rent Committee's report in respect of the petitioners' shops for the purpose of enhancement of rents and approve the same.

2. I have heard the submissions of the learned Standing Counsel appearing for the 3rd respondent. There is no representation for the petitioners. I have perused the material record.

3. When the matter, which is listed under the caption 'for orders', is taken up for hearing, the learned Standing Counsel appearing for the 3rd respondent would submit that this Court, on 02.08.2007, at the time of admission of this writ petition had granted interim stay as prayed for, for a period of four (04) weeks from that day and that subsequently the stay orders are not extended and that, therefore, the Executive Officer of the 3rd respondent Temple had conducted auction and that the present petitioners had become highest bidders in the said auction and that they are continuing in the possession of their respective shops and that, therefore, nothing survives for adjudication in this writ petition and that the writ petition may be dismissed as infructuous.

4. Recording the aforesaid submissions, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions pending, if any, in this writ petition shall

stand closed.
