P.V.V.Subrahmanyam v. Andhra University And Another
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.22735 OF 2004
ORDER
This writ petition is filed seeking the following relief: "...to issue a writ or order or direction, especially one in the nature of Mandamus: i) direct the respondents to conduct regular selection for the post of Lecturer in Politics and Public Administration in the first respondent University at the earliest ii) direct the respondents to consider the petitioner's case for appointment as regular lecturer and grant all consequential benefits and to grant such other relief or reliefs as this Hon'ble Court may deem fit and proper in the circumstances of the case."
When the matter is taken up for hearing, learned Standing Counsel appearing for the 1st respondent contends that during pendency of this writ petition, the case of the petitioner was considered for promotion to the post of Assistant Professor and that after rendering considerable length of service as Assistant Professor, he retired from service.
Learned counsel appearing for the petitioner submits that the service rendered by the petitioner prior to his promotion to the post of the Assistant Professor should be counted for the purpose of terminal benefits; that the petitioner has submitted a representation on 7.3.2015 and that appropriate orders be passed by directing the
respondents to consider the representation of the petitioner.
Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that ends of justice would be met if a direction is given to the respondents to consider the representation of the petitioner dated 7.3.2015. Accordingly, the Writ Petition is disposed of directing the respondents to consider the representation of the petitioner dated 7.3.2015 and pass appropriate orders thereon, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. No costs.
Pending Miscellaneous Petitions, if any, shall stand closed.
