This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, "BNSS"), seeking grant of pre-arrest bail to the petitioners, who are arrayed as accused Nos.1 to 4 in Crime No. 131 of 2026 on the file of II Town Police Station, Siddipet, Siddipet District, registered for offence punishable under Section 108 read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023.

Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for respondent - State.

The brief facts of the case are that the petitioners herein and the deceased are neighbours. There are disputes between the petitioners and the deceased with regard to the steps constructed by the petitioners on the way to the house of the deceased. The matter was placed before the elders and several panchayats were held. Even, basing on the complaints given by the deceased, District Collector concerned has given orders to the District Panchayat Officer concerned for enquiry, who in turn, instructed the Village Panchayat Secretary to remove the steps. However, the said Village Panchayat Secretary did not respond, except giving notice to the parties. Due to the attitude of the petitioners and their abusive language, the deceased deeply distressed and became disillusioned with life. While so, on 17.05.2026 at about 10.30 A.M. the deceased mixed the pesticide in cool drink and consumed the same at their agricultural land. While undergoing
treatment in the Government Hospital, the deceased died on 18.05.2026 at about 08.30 A.M. Basing on the complaint lodged by the son of the deceased, Police have registered a case, issued FIR and investigated into the same.

Learned counsel for the petitioners submits that the petitioners are innocent and they are falsely implicated in this case and that there are no specific overt acts attributed against the petitioners. It is further contended that the construction work of the said steps was going on for last four months and in respect of the said issue, there are claims and counter claims between the parties, and in such a case, it cannot be said that the deceased had consumed pesticide in view of the said dispute between them. It is further submitted that, even if the entire allegations are looked into, it does not constitute any offence against the petitioners. Hence, learned counsel prays this Court to grant anticipatory bail to the petitioners.

Per contra, learned Additional Public Prosecutor contended that in view of the circumstances narrated in the FIR, it is not a fit case to grant anticipatory bail to the petitioners.

It is evident from the material available on record that there are disputes between the parties with regard to the construction of steps by the petitioners on the way to the deceased house and several panchayats were held before village elders. Further, on the complaint made by the deceased, District Collector concerned has given orders to the District Panchayat Officer concerned for enquiry, who in turn, instructed the Village Panchayat Secretary concerned to remove the steps and the Village Panchayat Secretary has issued notices to the parties. This Court finds that there is nothing to show that the acts of the petitioners/accused Nos.1 to 4 have aided the deceased to commit suicide.

In the light of submissions made by both learned counsel and upon perusal of the material available on
record, this Court deems it appropriate to grant pre-arrest bail to the petitioners.

Accordingly, the present Criminal Petition is allowed on the following conditions:
1) Petitioners/accused Nos.1 to 4 are directed to surrender before the Station House Officer, II Town Police Station, Siddipet, Siddipet District, within a period of one week from today, and on such surrender, the Station House Officer shall release them on bail on executing a personal bond for Rs.10,000/- (Rupees ten thousand only) each with two sureties, for the like sum each to the satisfaction of the Station House Officer concerned;
2) Petitioners/accused Nos.1 to 4 shall appear before the concerned Station House Officer on every Friday between 10.00 A.M. and 02.00 P.M. for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required; and
3) Petitioners/accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhitha, 2023 and co-operate with the investigating officer in investigating the case. Miscellaneous applications, pending if any, shall stand closed.
